Terms & Conditions For BC Coastal Energy – As noted below as “BCCE”
A signed contract and deposit (30%-50% depending) is required before the commencement of any work. All payments are due upon receipt of invoice. Progress invoicing will occur bi-weekly, based on percentage completion with a total of 90% billed at the end of the rough in stage. Holdbacks of any kind will not be accepted on our invoices, they must be paid in full upon receipt. BC Coastal Energy Ltd. reserves the right to charge, and customer agrees to pay for trip costs, when customer schedules installation and job is not ready for installation without 24 hours notice. All cheques to be made payable to BC Coastal Energy Ltd. Payment by cheque or Visa/MasterCard ($5000.00 maximum) only. Goods remain the property of BC Coastal Energy Ltd. until paid in full. Interest will be charged on accounts aged over 30 days. Interest will be charged at 5% per month, 26.8 per annum compounded. BC Coastal Energy Ltd. is not responsible for structure, roofing, finishes, trim, gutters, equipment or other appurtenance which is unsound. Marketing: BC Coastal Energy Ltd. has the right to display signage on site and use photos for future training and promotion. All proposals are valid for 30 days.
PLEASE ALLOW 3-5 WEEKS NOTICE PRIOR TO DATE OF INSTALLATION. DUCT MUST BE INSTALLED PRIOR TO ELECTRICAL WIRING AND PLUMBING SUPPLY ROUGH-IN. Any wiring or plumbing that is installed prior to our start of installation will increase our install time and may be charged as an extra. Note: Use of equipment during the construction phase will void manufacturer's warranties. Manufacturer extended warranties may be available.
Any insulating of ducts in slab or unheated areas is extra. Any gas fitting or final connections. Line voltage wiring or electrical (line or low voltage) permits; carpentry, hot water tank or plumbing; concrete cutting or coring; digging, drilling, trenching or excavating. Builder to provide access for all duct routing. Any make-up air fans, duct or reheat coil systems for high capacity exhaust fan (i.e. large kitchen fan in a NAFFVA home). Custom grilles/registers are extra. Statutory declaration. Any design or duct changes from quoted drawings due to structural or aesthetic changes may be extra. The BC Building Code calls for two planes of moisture protection to avoid rainwater penetration problems, this is not included and must be completed by others.
Hours of Operation
8:00am AM to 4:00 PM, Monday through Friday 10:00am-4pm Saturdays, excluding Statutory Holidays. If you specifically request that service be provided outside of BCCE’s regular weekday business hours overtime charges will apply in accordance with our overtime policy.
Overtime charges will apply on a quoted contract if you, the customer, requests that we continue after hours for cosmetic, convenience, or other non-heat related reasons. If BCCE has elected to stay outside our regular business hours to ensure you have heat, there will be no overtime billed to you.
BCCE warrants all paid labour against defects in workmanship for a period of one year. We do not warrant any parts other than those we supplied and replaced, nor do we assume any liability for any damage resulting from the failure of the part(s) that we did replace. BCCE does not warrant new problems that may arise in the areas where the previous work took place, unless directly related to the previous work.
The manufacture provides any applicable part warranty and our liability is limited to the free replacement of any part that we supplied and installed if it fails within one year.
Third party warranty providers and manufacturers warranties may be different. Please refer to your warranty papers for more specific information.
York and Daikin extended warranties - Heat exchangers and other major items covered under an extended warranty (outside of the one year warranty) will be billed to and paid by the customer first. After manufacturer has processed the warranty BCCE will refund that portion of the bill to the customer by credit. The customer should note that their warranty has limits with regard to the amount of labour covered. Any time or rate difference between what is covered by the warranty and what BCCE charges will be the responsibility of the homeowner. BCCE will process all warranty claims on behalf of the customer. BCCE will ensure all documentation and processes are completed correctly and in a timely manner to expedite the warranty process.
Scheduling warranty repairs - BCCE will make every effort to contact a customer to remedy a warranty. In the event BCCE cannot reach the Customer after three reasonable attempts or is not permitted to perform the service after three attempts to schedule such service, the Customer agrees that BCCE shall have fulfilled its obligations as to such service hereunder, and BCCE shall retain all funds associated with service and be relieved of any further obligations to provide the services.
Extras / Change Orders
Any work that is not within the scope of the original quote is an extra, also termed a Change Order, and billed on a time and material basis.
If the Change Order is necessary and initiated by BCCE you will be contacted directly for approval. If you cannot be reached and work must progress, BCCE reserves the right to make a judgment call that is in your best interest and the most prudent course of action available at the time. You will be advised as soon as possible.
If you initiate the Change Order, you will be advised that you have exceeded the original scope of work and that you will be billed on a time and materials basis for that work. Your approval will be necessary for the commencement of the extra work. Change order invoices are payable upon receipt of invoice.
Chargeable time for extras:
a.Work performed – this is the technical part of the job, travel and time picking up specialized tools, or required material, set-up and clean-up, and extended consultation beyond 15 minutes.
b.Chargeable material includes all materials purchased in excess of that needed for the quoted portion of the job.
By purchasing BCCE products or services you expressly consent and permit administration to contact you by email, mail or phone to schedule and/or provide you with the products and services associated with your purchase. You may also consent to receive future communications and marketing about the products and services we offer via phone, email, or mail. You may withdraw your consent to this additional communication at any time by contacting us by phone, email or mail.
Deposits on heating contracts are non-refundable. Cancellations of furnace installations, heat pumps, HRV’s and other heating accessories must be a minimum of five (5) business day’s notice. For service calls you may be required to pay a charge when booking your call and this is non-refundable. BCCE requires a minimum 24 hours notice for cancelling a service call. You do not need to give a reason for cancelling. Customer may cancel by phone, or email.
BCCE carries liability insurance and is Bonded.
BCCE shall not accept liability for the failure of any part or system outside the scope of work. BCCE technicians’ presence on site does not create an assumed responsibility for any and all HVAC of the home or building. Normal, reasonable actions for repair will sometimes result in a new issue where the normal wear of that item and reasonable end of life is affected as a result of the repair where the repair has been conducted within the professional standards required by his trade.
